The man was referred to Marriott Oliver by the Barrister who represented him in Local Court.
Marriott Oliver reviewed relevant legislation and quickly established, with the judgement as it stood, the man could not hold a firearms licence.
An appeal was lodged. Despite our best efforts his applications were denied. However, in the appeal decisions there were indicators that an application at a later date might be more favourably viewed.
We advised the man of likely future success and after four years he reapplied and was again denied. He returned to Marriott Oliver to see if anything further could be done.
Marriott Oliver pursued a less arduous and costly approach of internal review of the original decision by a member of the NSW Police Force. Rather than submitting the standard documentation, Marriott Oliver prepared a detailed submission in support of the licence renewal with reference to past judgments and relevant case law.
The review was successful and the man’s licence was renewed. Marriott Oliver’s spot on advice, and thorough preparation achieved a successful result without the considerable expense and delay of further appeals.
